A murder suspect in Ohio was wrongly released from jail due to a typographical error.
A warrant for Amarion Sanders, 22, was issued by Timothy J. McGinty, who is serving as a visiting judge in Cuyahoga County Common Pleas Court, in a filing Tuesday (June 25) and authorities have launched a search for the suspect, the Cleveland Plain Dealer reports. The court intended to release Antonio Seymore, 35, who was accused of assault and theft after his case was thrown out on Monday (June 24), according to records obtained by the newspaper.
The issue stemmed from the cases having a one digit difference in docket numbers as Sanders' case number was 685908 and Seymore's was 685909. Seymore's case was dismissed by county prosecutors on Monday due to a witness failing to appear in court during the trial.
Sanders was being held on a $1 million bond when he was wrongly released from custody. The 22-year-old is accused of killing Derek Driscoll on September 23, 2023, and scheduled for trial on August 19, 2024.
McGinty, who has overseen cases in the courtroom of former Judge Daniel Gaul the past two weeks following Gaul's December dismissal by the Ohio Supreme Court due to his handling of multiple cases, declined to comment when reached by the Cleveland Plain Dealer on Tuesday, according to the newspaper.
